The present economic environment has fostered fierce competition among construction contractors who are vying for the remaining public work projects. The General Accountability Office (“GAO”) reports that bid protests have increased for the fourth straight year. From 2009 to 2010 bid protests have increased by 16%. The economic conditions clearly remain a major factor in the rise in protests.
